Indigenous leaders from RSS and São Marcos participate in a hearing at the MPF to address the amount of compensation that Indigenous peoples suffered due to racism and prejudice

On Wednesday, 18, regional leaders of the Raposa Serra do Sol and São Marcos Indigenous Lands, were in a hearing with the Federal Prosecutor of the 7th Office of the Federal Public Ministry (MPF), Alisson Marugal. The meeting took place at the MPF headquarters. The Legal Counsel of the Indigenous Council of Roraima (CIR), through lawyers Junior Nicacio and Ivo Cípio Aureliano, the executive coordination of the CIR, Edinho Batista and Maria Betânia also attended the hearing.

The hearing with the prosecutor and indigenous leaders was to deal with the compensation to the indigenous peoples of the Raposa Serra do Sol and São Marcos Indigenous Lands for discrimination suffered in the documentary "FAB 2068 — The History of the Amazon". The Public Civil Action (0000288-75.2009.4.01.4200) was filed by the MPF in 2009, after a letter from the CIR informing and requesting measures. The Federal Court recognized the seriousness of the discrimination and condemned both the documentary filmmaker, who made the film, and the Army Military, who had a discriminatory speech, to pay moral damages to the indigenous peoples.

In 2009, the documentary was released in the legislative assembly of the state of Roraima. The documentary featured the speech of an Army Colonel with prejudiced and discriminatory content in relation to the indigenous peoples of Roraima. It also contested the demarcation of indigenous lands, using profane expressions that directly offend and discriminate against indigenous peoples.

The leaders considered the court's decision important and historic

At the hearing, the Federal Prosecutor informed that the case has become final and unappealable (there is no further appeal). The process is in the judicial execution phase in the amount of R$ 200 thousand reais, today updated at about R$ 900 thousand reais. The amounts were blocked from both defendants: CLAUDIO BARBOSO DE FIGUEIREDO and LUIZ RIBEIRO MARGARIDO.

The Federal Court also determined that the resource be directed to the National Indian Foundation (FUNAI) to serve the São Marcos and Raposa Serra do Sol indigenous lands, but through the participation of indigenous communities.

The leaders considered the court's decision important and historic. Unfortunately, indigenous peoples still suffer attacks, persecution and hate speech, often perpetrated by authorities who should ensure respect for the constitutional precepts that recognize the rights of indigenous peoples. Finally, the organizations and leaders reaffirmed that they demand that values be invested in indigenous communities, victims yesterday and today of discrimination and hate speech.
